Disclosure Scotland Update – Your duty to refer
This duty upon your organisation helps to protect children and adults across Scotland when they are using essential services.
It helps to ensure that those who commit harmful behaviour towards children and protected adults are not given the chance to continue this behaviour. We don’t bar everyone referred to Disclosure Scotland, but rest assured – we will bar unsuitable people.
Making referrals when the referral grounds are met also prevents your organisation from committing a criminal offence under Protection of Vulnerable Groups (PVG) legislation. Disclosure Scotland are obliged to report this offence to the police.
Disclosure Scotland fund VSDS solely to support you in the whole PVG process, which includes you complying with your duty to refer.
If you’re unsure whether you need to refer a specific case, contact VSDS for advice here.
